Short answer
Freelance digital marketers paid through PayPal, Wise or Payoneer follow one set of 2026 rules. The FEMA Export and Import Regulations, 2026 require realisation within nine months of the invoice. A GST LUT under CGST Rule 96A allows billing without IGST. Each receipt is reported under an RBI purpose code, and a FIRC or FIRA proves the remittance.

Which RBI and GST rules apply to freelance digital marketers paid by foreign clients?
A freelance digital marketer who bills a foreign client is an exporter of services under the FEMA Export and Import Regulations, 2026, which apply from 1 October 2026. For GST, the work is an export of services when all five conditions in IGST Act section 2(6) are met, which makes it a zero-rated supply under section 16(1)(a). The same rules apply whether the client pays by PayPal, Wise, Payoneer or a direct bank transfer.
| Rule | Source | Clause | Plain meaning | Best for |
|---|---|---|---|---|
| Realisation of export value | FEMA Regulations, 2026 | Regulation 5(1)(a) and provisos | Export value must be realised and repatriated within nine months from the invoice date, or twelve months when invoiced or settled in Indian rupees. The AD bank may extend the period when the exporter gives reasons for the delay. | Marketers whose clients pay late or in milestones |
| Export Declaration Form (EDF) | FEMA Regulations, 2026 | Regulation 3(2) | An EDF goes to the specified authority, which for services other than software is the AD bank, within 30 days from the end of the month in which the invoice was raised. | Place of supply | IGST Act, 2017 | Section 13(2) | For services outside sub-sections (3) to (13), the place of supply is the location of the recipient of services. | Remote SEO, ads and campaign work for clients abroad |
| GST registration threshold | CGST Act, 2017 | Section 22(1) and first proviso | Registration is required once aggregate turnover in a financial year exceeds ₹20 lakh, or ₹10 lakh in special category States. Confirm your own position with a GST practitioner. | Marketers deciding whether to register for GST |
| Zero-rated supply under LUT | IGST Act s.16; CGST Rule 96A | Section 16(3); Rule 96A(1)(b) | A registered person can export without paying IGST under a bond or an LUT in FORM GST RFD-11 furnished before export. If payment is not received within one year or the FEMA period with any RBI extension, whichever is later, tax and interest are due fifteen days after that. | GST-registered marketers invoicing without IGST |
| Purpose code reporting | FEMA Regulations, 2026; RBI Circular No. 84 of 2012 | Regulation 18(2); Circular 84 paragraph 3 | The AD bank reports foreign exchange transactions under FETERS, and each transaction carries a purpose code from the RBI list. | Marketers checking how a receipt is classified |

What documents follow each digital marketing payment from abroad (FIRA, e-BRC, EDF, LUT)?
Each foreign payment to a digital marketer needs a paper trail for FEMA and GST. The LUT is filed before the first export invoice, each invoice carries the export endorsement under CGST Rule 46, and the EDF reaches the AD bank within 30 days of the invoice month end. A FIRC or bank realisation certificate supports any refund claim under CGST Rule 89(2)(c).
| Document | Who issues it | When needed | Best for |
|---|---|---|---|
| LUT (FORM GST RFD-11) | The freelancer files it on the GST portal under Services, User Services, Furnish Letter of Undertaking | Before export, under Rule 96A(1) | GST-registered marketers billing without IGST |
| Export invoice with endorsement | The freelancer | On every export invoice; under an LUT it reads "SUPPLY MEANT FOR EXPORT UNDER BOND OR LETTER OF UNDERTAKING WITHOUT PAYMENT OF INTEGRATED TAX" (Rule 46) | All GST-registered marketers |
| EDF | The freelancer submits it to the AD bank | Within 30 days from the end of the invoice month, or on or before the date of receipt of payment (Regulation 3(2)) | Marketers invoicing from 1 October 2026 |
| FIRC or FIRA | The AD bank. Rule 89(2)(c) asks for Bank Realisation Certificates or Foreign Inward Remittance Certificates for export of services refunds. Neither the 2026 Regulations nor Rule 89 defines a FIRA, so check with your AD bank or payment service what document it issues. | After each foreign payment is credited | Marketers proving export income or claiming GST refunds; see FIRC vs FIRA vs e-BRC |
| e-BRC | DGFT issues it as confirmation that the exporter received payment against the export (DGFT eBRC FAQs) | After the bank sends the inward remittance message | Marketers who need DGFT proof of realisation; see what is an e-BRC |
| EDPMS declaration | The freelancer gives it to the AD bank | For invoices up to ₹10 lakh, to close the EDPMS entry (Regulation 4(2)) | Marketers on small monthly retainers |
What changes in 2026 for freelance digital marketers paid from abroad?
In 2026 freelance digital marketers move to a new FEMA export framework and a new income tax law. The FEMA Export and Import Regulations, 2026 apply from 1 October 2026, and RBI Circular No. 20 supersedes the Master Direction on Export of Goods and Services from that date. The Income Tax Act, 2025 replaced the 1961 Act on 1 April 2026.
- New framework: Circular No. 20 paragraph 4 supersedes the export and import Master Directions and the circulars listed in its Annex from 1 October 2026. See what changed in the FEMA export rules.
- Realisation: An amendment dated 22 September 2026 set the period in Regulation 5(1)(a) at nine months from the invoice date, or twelve months for rupee invoicing. See export realisation period.
- EDF: Service exporters file an EDF within 30 days from the end of the invoice month under Regulation 3(2), and one EDF may cover a whole month. See the EDF form.
- Small invoices: EDPMS entries for invoices up to ₹10 lakh can close on the exporter's declaration under Regulation 4(2).
- Income tax: The Income Tax Act, 1961 stands repealed from 1 April 2026. Income from tax year 2026-27 onwards falls under the 2025 Act, while earlier years stay under the old Act.

Frequently asked questions
Does a freelance digital marketer in India need a GST LUT to receive PayPal, Wise or Payoneer payments in 2026?
A GST-registered digital marketer who wants to bill foreign clients without IGST must furnish an LUT in FORM GST RFD-11 before export under CGST Rule 96A. The payment platform does not change this. Without an LUT or bond, IGST is paid on the export and can be claimed back as a refund. See LUT filing on the GST portal.
Is a FIRC needed for digital marketing export receipts under CGST Rule 89?
For a GST refund on export of services, CGST Rule 89(2)(c) asks for a statement of invoices with the relevant Bank Realisation Certificates or Foreign Inward Remittance Certificates. A digital marketer should keep a FIRC or FIRA for every foreign receipt, whichever platform the client used, as proof of export income.
What is the RBI export realisation deadline for freelance digital marketers under FEMA 2026?
Under Regulation 5(1)(a) of the FEMA Regulations, 2026, a digital marketer must realise and repatriate the invoice value within nine months from the invoice date. The period is twelve months when the export is invoiced or settled in Indian rupees. The AD bank may allow an extension when the exporter explains the delay.
Must a freelance digital marketer register for GST under CGST section 22 before exporting services?
CGST Act section 22(1) makes registration compulsory once aggregate turnover in a financial year exceeds ₹20 lakh, or ₹10 lakh in special category States. Registration is also what allows a marketer to export under an LUT. Confirm your own position with a GST practitioner. See GST registration for freelancers.
Is P1007 the correct RBI purpose code for paid search and social ads management exported from India?
RBI's FETERS purpose codes describe P1007 as "Advertising, trade fair service", which fits paid campaign management. Strategy consulting fits P1006, and standalone research fits P1016. No code names digital marketing. Confirm the code with your AD bank before the payment is credited. See wrong purpose code consequences.
Does a freelance digital marketer file an EDF with the AD bank from October 2026?
Yes. Regulation 3(2) of the FEMA Regulations, 2026 requires a service exporter to submit an EDF within 30 days from the end of the month in which the invoice was raised. For services other than software, the specified authority is the AD bank. One EDF can cover all exports made in a month.
Does IGST section 13(2) make SEO work for a US client an export of services?
IGST Act section 13(2) sets the place of supply as the location of the recipient for services outside sub-sections (3) to (13). For remote SEO work for a US client, that is usually outside India. The supply is an export only if all five conditions in section 2(6) are also met.
Do freelance digital marketers need a DGFT e-BRC for export receipts in 2026?
The DGFT eBRC FAQs describe an e-BRC as DGFT's confirmation that an exporter received payment against an export of goods or services. It links to the bank's inward remittance message. Check whether your GST refund or export scheme claim needs one. See what is an e-BRC.
