Which RBI and GST rules apply to freelance developers in India?
Freelance developers in India follow the FEMA export rules and the GST export of services rules when the client is abroad. From October 01, 2026 the FEMA (Export and Import of Goods and Services) Regulations, 2026 cover declaration, realisation and reporting, and treat software as a service. Under GST, section 2(6) of the IGST Act defines export of services and section 16 zero rates it. The same rules apply whichever platform or bank receives the money.
| Rule | Source | Clause | Plain meaning | Best for |
|---|---|---|---|---|
| Software is a service | FEMA Regulations 2026 | Reg 2(1)(e) and Explanation | Software means any computer programme, database, drawing or design on a non-physical medium. For these regulations, services include software. | Developers delivering code through repositories or downloads |
| EDF for software | FEMA Regulations 2026 | Reg 3(2) and Reg 2(1)(f)(iii) | Declare the full export value on an EDF within 30 days from the end of the invoice month, with the AD bank or STPI. | Place of supply | IGST Act | Section 13(2) | For services not listed in sub-sections (3) to (13), the place of supply is the location of the recipient. | Remote development and consulting for foreign clients |
| LUT for zero rating | IGST Act and CGST Rule 96A | Section 16(1)(a), 16(3); Rule 96A(1)(b) | Export without IGST under an LUT in FORM GST RFD-11. What documents follow each payment for a freelance developer (FIRA, e-BRC, EDF, LUT)?
Each foreign payment to a freelance developer is backed by an export invoice, a FIRA or FIRC, an EDF and, if GST registered, an LUT. An e-BRC can be generated on DGFT under the self-certified e-BRC guidelines. From October 01, 2026 the EDF under Regulation 3(2) is the software declaration, after Circular No. 20 superseded the SOFTEX circulars.
| Document | Who issues it | When needed | Best for |
|---|---|---|---|
| Export invoice | The developer | For each project, milestone or billing cycle; the invoice date starts the nine-month realisation period | All freelance developers |
| LUT (FORM GST RFD-11) | The developer files it on the GST portal | Before exporting without IGST, selected for each financial year | GST-registered developers |
| Export Declaration Form (EDF) | The developer files it with the AD bank or STPI (SEZ units with the Development Commissioner) | Within 30 days from the end of the invoice month; one EDF can cover all clients that month | Software exports from October 01, 2026 |
| FIRA or FIRC | The AD bank or the payment provider that credits the INR | After each foreign payment reaches the Indian account | Proof of foreign receipt for GST, income tax and the bank |
| e-BRC | The developer generates it on the DGFT portal from bank remittance data | When showing realisation or claiming export benefits | Receipts under P0802, P0803, P0807 or P0103 |
What changes in 2026 for freelance developers in India?
In 2026 freelance developers move to a new FEMA export framework, EDF filing for software and a new income tax law. The FEMA Regulations 2026 took effect on October 01, 2026, and the September 2026 amendment set realisation at nine months instead of fifteen. GST zero rating and the LUT continue unchanged.
- SOFTEX ends: Software exports are declared on an EDF within 30 days of the invoice month end under Regulation 3(2). Circular No. 20 superseded the SOFTEX circulars from October 01, 2026.
- Nine months: The amendment FEMA 23(R)/(1)/2026-RB replaced fifteen months with nine months for realisation, and eighteen with twelve months for INR invoices, before the 2026 regulations took effect.
- Unpaid invoices: If proceeds stay unrealised for over one year past the due date, further exports need full advance or an irrevocable letter of credit under Regulation 13.
- Income tax: The Income-tax Act, 2025 replaced the 1961 Act on April 01, 2026, starting with Tax Year 2026-27. Its FAQ 25 says the presumptive schemes, including section 44ADA, are now in section 58.
- Faster credit: RBI asked banks in an April 09, 2026 circular to endeavour to credit inward payments received in forex market hours on the same business day. The circular applies six months from its date, in October 2026.

Frequently asked questions
What is the RBI purpose code for software consultancy in export of services from India?
The code is P0802. The FETERS purpose code list describes it as "Software consultancy/implementation (other than those covered in SOFTEX form)". It sits in group 08, computer and information services. Freelance developers who consult or implement software for foreign clients usually receive payments under it. See P0802 purpose code.
Should a freelance developer choose P0802 software consultancy or P0807 off-site software exports?
P0802 fits consulting, implementation and integration of software. P0807, "Off-site Software Exports" in the FETERS list, fits code written in India and delivered abroad. Both work for IT services e-BRCs under the DGFT guidelines. Match the code to what the invoice describes and confirm with your AD bank.
Does the P0802 code wording about SOFTEX matter after the 2026 FEMA export regulations?
The P0802 description in the FETERS list linked here still says "other than those covered in SOFTEX form". From October 01, 2026, Circular No. 20 superseded the SOFTEX circulars and software is declared on an EDF. No updated wording was found, so ask your AD bank how it now applies P0802.
Is GST payable on software consultancy for a foreign client under IGST section 2(6)?
Software consultancy for a foreign client is an export of services when all five conditions in section 2(6) are met, and it is zero rated under section 16. A registered developer can supply it without paying IGST under an LUT. The client and place of supply must be outside India, with payment in convertible foreign exchange or RBI-permitted INR.
Does a freelance developer paid via PayPal, Wise or Payoneer need a GST LUT under Rule 96A?
A GST-registered developer needs an LUT to export without paying IGST, whichever platform collects the money. Rule 96A requires FORM GST RFD-11 before the export. It is filed under Services, User Services, Furnish Letter of Undertaking on the GST portal, for each financial year.
Does a freelance developer file an EDF for software exports paid through a platform in 2026?
Yes. Under Regulation 3(2) an exporter of services files an EDF within 30 days from the end of the invoice month. Clause (b) lets only exporters of services other than software file on or before the payment date. One EDF can cover all clients in a month. See SOFTEX for freelancers for the history.
What is the RBI export realisation period for a freelance developer's invoice in 2026?
The period is nine months from the invoice date under Regulation 5(1), or twelve months for INR invoices. The September 2026 amendment cut it from fifteen months before the rules took effect. The AD bank may extend the period if the developer explains the delay.
Which income tax section replaces 44ADA for freelance developers under the Income-tax Act, 2025?
The Income Tax Department's FAQ on the new Act says the presumptive schemes, including section 44ADA, are consolidated in section 58. The 2025 Act applies from Tax Year 2026-27. The same FAQ says the repeal does not disturb tax years before April 1, 2026. Check section 58's conditions before relying on it.
