Short answer
In 2026, an Indian exporter using Wise Business or Payoneer US account details stays under RBI's FEMA rules. Regulation 5(CA) lets an exporter hold a foreign currency account abroad if unused funds come home by the end of the next month. The FEMA Regulations 2026 also require an EDF and realisation within nine months. GST zero-rating needs an LUT.

- A US bank account in your own name: A resident exporter may hold a foreign currency account with a bank outside India for export receipts under Regulation 5(CA), and must use the funds for imports or bring them to India by the end of the next month. The US bank sets its own rules on who can open an account.
Which RBI rules govern a US dollar account used from India to receive international payments?
The RBI rule that applies depends on whose name the US dollar account is in. An account abroad in your own name falls under Regulation 5(CA), while collection by a cross-border payment aggregator falls under the Master Direction on Payment Aggregators. In both cases the FEMA Regulations, 2026 apply to each export invoice. Ask the platform whether its US details are an account held in your name or a collection account it operates. See foreign currency account abroad for exporters.

What documents and GST apply to US dollar payments received in India for exported services?
Four documents usually surround a US dollar payment for services: the LUT, the export invoice, the EDF and the bank's FIRC or FIRA. GST is zero-rated for an export of services under IGST section 16 when the conditions in section 2(6) are met, including payment in convertible foreign exchange. Your US client may also ask for IRS Form W-8BEN. See FIRC vs FIRA vs e-BRC.
| Document | Who issues it | When needed | Best for |
|---|---|---|---|
| LUT in FORM GST RFD-11 | The exporter furnishes it to the jurisdictional Commissioner | Before export, under CGST Rule 96A; tax with interest is due within 15 days after one year or the FEMA realisation period, whichever is later, from the invoice date, if payment is not received | GST-registered exporters invoicing without IGST |
| Export invoice | The exporter | For each supply; payment in convertible foreign exchange or rupees where the RBI permits is one condition of export of services | Every foreign client |
| EDF | The exporter files it with the AD bank or other specified authority | Within 30 days from the end of the invoice month; services other than software may file on or before the date of receipt | All service exports from 1 October 2026 |
| FIRC or FIRA | The bank or entity that handles the receipt in India; ask which document it provides | After the money reaches India; the form and timing depend on the bank or platform | Keeping a record of each foreign receipt |
| PA-CB documents for EDPMS | The cross-border payment aggregator | The PA-CB gives the exporter's AD bank the documents needed to close EDPMS entries (para 11(h)) | Exporters paid through a platform |
| Form W-8BEN | The Indian individual completes it for the US payer | When the US withholding agent or payer asks for it, per the IRS; entities use Form W-8BEN-E | Freelancers with US clients |
| Schedule FA in the income tax return | The resident taxpayer | For foreign bank accounts held at any time in the calendar year ending 31 December, per the Income Tax Department guide; ITR-1 and ITR-4 have no Schedule FA | Residents holding an account abroad in their own name |
What changed in the rules this year?
The main change is that the FEMA (Export and Import of Goods and Services) Regulations, 2026 came into force on 1 October 2026. A.P. (DIR Series) Circular No. 20 superseded the Master Direction on Export of Goods and Services from the same date. The foreign currency account rule in Regulation 5(CA) was last changed in October 2025.
- New regulations: The 2026 Regulations replaced the 2015 export regulations from 1 October 2026, with an EDF for all services, including software.
- Realisation: An amendment dated 22 September 2026 set realisation at nine months, or twelve months for rupee invoicing, replacing the fifteen and eighteen months first notified (Regulation 5 footnotes).
- IFSC window: Under the Seventh Amendment notified on 6 October 2025, an exporter account with an IFSC bank has until the end of three months to repatriate, against the next month elsewhere (Regulation 5(CA)).
- Aggregators: The Master Direction on Payment Aggregators dated 15 September 2025 consolidated the PA-CB rules and repealed the older online payment gateway circulars, except for an existing PA-CB that applied by 30 April 2024 and awaits a decision. See PA-CB vs OPGSP.
- Small invoices: Export invoices up to Rs 10 lakh can be closed in EDPMS on the exporter's declaration, including in quarterly bulk (Regulation 4(2)).

Frequently asked questions
Can a resident Indian freelancer legally hold a US bank account in their own name to receive international payments in 2026?
Regulation 5(CA) lets a person resident in India, being an exporter of goods or services, hold a foreign currency account with a bank outside India. The text says exporter and does not limit this to companies. Funds not used for imports must reach India by the end of the next month after receipt. Confirm your case with your AD bank.
Is USD account eligibility from India the same as RBI permission for a foreign currency account?
No. A platform's eligibility rules decide whether it will onboard you, while FEMA decides what you may do with the money. An account abroad in your name follows Regulation 5(CA). A platform acting as a cross-border payment aggregator follows the Master Direction on Payment Aggregators. Check which structure applies before you invoice.
How long can US dollars from a US client stay outside India under RBI's 2026 rules?
In an exporter's own account abroad, unused funds must be repatriated by the end of the next month after receipt, or three months for an IFSC bank, under Regulation 5(CA). Separately, the full export value must be realised within nine months from the invoice date under Regulation 5(1) of the 2026 Regulations.
Can I keep US dollars in India instead of converting them when using an EEFC account?
Yes, within limits. An EEFC account with an AD bank in India can take 100 percent of foreign exchange earnings received through normal banking channels, according to para 3.1 of the Master Direction. Each month's accruals are converted by the end of the next month, after approved uses. See what is an EEFC account.
Does GST apply to US client payments received through US account details from India?
Services to a US client are an export of services under IGST section 2(6) when its conditions are met, including a recipient and place of supply outside India and payment in convertible foreign exchange. Export of services is zero-rated under section 16. File an LUT under Rule 96A to invoice without IGST. See what is an LUT.
Do I still file an EDF when a US client pays into a Wise Business or Payoneer USD account?
Yes. Regulation 3(2) of the FEMA Regulations, 2026 requires every exporter of services to file an EDF within 30 days from the end of the invoice month, with no exception based on the receiving account. One EDF can cover all of a month's exports. Ask your AD bank how it wants platform receipts matched. See the EDF guide.
Do I need Form W-8BEN to receive US dollar payments from a US client in India?
The IRS says a foreign person who is the beneficial owner of an amount subject to withholding gives Form W-8BEN to the withholding agent or payer, and submits it when requested. The IRS lists Form W-8BEN-E separately for entities, such as Indian companies. See W-8BEN for Indian freelancers.
Must a US bank account held from India be shown in Schedule FA of the income tax return?
Residents must disclose foreign bank accounts held at any time in the calendar year ending 31 December in Schedule FA, according to the Income Tax Department guide. ITR-1 and ITR-4 have no Schedule FA, so another form is needed. Taxpayers who are not ordinarily resident or non-resident need not complete Schedule FA.
