Short answer
Indian architecture firms paid through Wise, Payoneer or PayPal in 2026 follow RBI and GST rules on every foreign receipt. Each receipt carries a purpose code, usually P1009 in the RBI receipt purpose codes. Exporting without IGST under IGST section 16 needs an LUT. The FEMA Regulations 2026 require realisation within nine months.

Which RBI and GST rules apply to architecture firms in India with foreign clients?
Architecture firms with foreign clients are exporters of services under FEMA, and under GST only when the building is outside India and the other export conditions are met. From October 01, 2026 the FEMA (Export and Import of Goods and Services) Regulations, 2026 set the declaration, realisation and reporting rules. For GST, section 13(4) of the IGST Act places services directly in relation to immovable property, including architects' services for construction work, where the property is located or intended to be located. A design for a building in India is therefore taxable in India even when the client pays from abroad.

Which purpose code applies to architecture firms in India?
Architecture firms usually receive foreign payments under P1009, which the RBI receipt purpose codes describe as architectural services; engineering work has its own code, P1014. Codes starting with S, such as S1009, are for payments made out of India, so they do not apply to fees received. The AD bank reports the code under FETERS as set out in Circular No. 84 of 2012. See P1009 purpose code for more detail.

What documents follow each payment for an architecture firm (FIRA, e-BRC, EDF, LUT)?
Each foreign payment to an architecture firm is backed by an export invoice, an inward remittance advice (FIRA or FIRC), an EDF and, for GST, an LUT. An e-BRC can be generated on DGFT under the self-certified e-BRC guidelines, which require invoice SAC codes to match the service. Since October 01, 2026 the EDF under Regulation 3(2) applies to services and software alike, after Circular No. 20 superseded the SOFTEX circulars.
| Document | Who issues it | When needed | Best for |
|---|---|---|---|
| Export invoice | The architecture firm | For every design stage or fee milestone; the invoice date starts the nine-month realisation period | All firms |
| LUT (FORM GST RFD-11) | The firm files it on the GST portal | Before the first export invoice of each financial year | GST-registered firms exporting without paying IGST |
| Export Declaration Form (EDF) | The firm files it with the specified authority: the AD bank (or STPI for software), or the SEZ Development Commissioner for SEZ units | Within 30 days from the end of the invoice month; services other than software may file on or before the payment date | All firms exporting services from October 01, 2026 |
| FIRA or FIRC | The AD bank that receives the inward remittance; ask the payment provider how its advice is issued | After each foreign payment is credited | Showing the foreign receipt behind each export invoice |
| e-BRC | Generated by the firm on the DGFT portal from inward remittance (IRM) data reported by the bank | When the firm needs a record of realisation against an export invoice; check the DGFT portal | Firms matching P1009 receipts to invoices |
What changes in 2026 for architecture firms in India?
In 2026 architecture firms move to a new FEMA export framework, a nine-month realisation period and a new income tax law. The FEMA Regulations 2026 took effect on October 01, 2026, and the September 2026 amendment, effective the same day, cut the realisation period from fifteen to nine months. The IGST place of supply rule and the Rule 96A LUT process are not part of these FEMA changes.
- New regulations: Circular No. 20 superseded the Master Directions on export and import of goods and services from October 01, 2026.
- Nine months: The amendment notification FEMA 23(R)/(1)/2026-RB replaced fifteen months with nine months for realisation, and eighteen with twelve months for INR invoices.
- Unrealised exports: If proceeds stay unrealised for over one year past the due date, further exports need full advance or an irrevocable letter of credit under Regulation 13.
- Income tax: The Income-tax Act, 2025 replaced the 1961 Act from April 01, 2026. Its FAQ 25 says the old presumptive schemes, including section 44ADA, are now in section 58.
- Faster credit: RBI asked scheduled commercial banks in April 2026 to endeavour to credit inward payments received in forex market hours on the same business day. The direction takes effect six months from the April 09, 2026 circular.

Frequently asked questions
Is S1005 or P1009 the RBI purpose code for an architecture firm receiving fees from a foreign client?
P1009 is the receipt code for architectural services. In the RBI purpose code list, codes starting with P are receipts and codes starting with S are payments abroad. S1005 is the payment code for accounting, auditing, book keeping and tax consulting services. Architecture firms receiving fees from abroad use P1009 and confirm it with their AD bank.
Is GST charged when an Indian architect designs a building in India for a client abroad under IGST section 13(4)?
Yes. Under section 13(4) the place of supply of architects' services is where the immovable property is located or intended to be located. A building in India puts the place of supply in India, so condition (iii) of section 2(6) fails and the fee is not an export of services.
Is GST charged on architectural design for a building outside India paid via Wise, Payoneer or PayPal?
No IGST is charged when all five conditions of section 2(6) are met and the firm exports under an LUT, because the service is then a zero rated supply under section 16. The platform does not change this. The conditions include a firm in India, a client and building outside India, and payment in convertible foreign exchange or permitted INR.
When must an architecture firm file the GST LUT under Rule 96A?
Rule 96A requires the LUT in FORM GST RFD-11 before the export. The GST portal form asks which financial year the LUT is for, and is filed through Services, User Services, Furnish Letter of Undertaking. Without an LUT, IGST is paid on the export invoice. Ask a GST adviser about any refund route.
Does an architecture firm file the EDF as software or as services under the FEMA Regulations 2026?
It depends on what is delivered. Regulation 2(1)(e) defines software to include any drawing or design on a non-physical medium. Software EDFs are due within 30 days from the end of the invoice month. Exporters of other services may file on or before the payment date. Ask your AD bank which applies to your drawings.
What is the RBI export realisation period for architecture invoices in 2026?
The period is nine months from the invoice date under Regulation 5(1) of the FEMA Regulations 2026, or twelve months for INR invoices. The January 2026 text said fifteen months until the September 2026 amendment. The AD bank may extend the period if the firm gives reasons for the delay.
Can an architecture firm generate an e-BRC on DGFT for P1009 receipts?
Rule 10 of DGFT's self-certified e-BRC guidelines lists four purpose codes for IT services only, and P1009 is not among them. Remittances can be clubbed only when the currency, bank name and account number match. For service exports, only invoices with SAC codes matching the service can be attached. Check the portal for your firm's case.
Does the EDPMS entry for a small architecture invoice need bank documents to close?
Not for invoices up to Rs 10 lakh. Under Regulation 4(2) the AD bank may close the EDPMS entry on the exporter's declaration that payment was realised, and the declaration can be given quarterly for bulk closure. Larger invoices are closed by the AD bank after it checks the transaction.
