Short answer

When a foreign client deducts withholding tax, an Indian resident can usually claim credit for that foreign tax against Indian income tax on the same income. The credit is capped at the Indian tax on that income. From tax year 2026-27, the relief sits in sections 159 and 160 of the Income-tax Act, 2025.

What is foreign withholding tax for an Indian freelancer or exporter?

Foreign withholding tax is income tax that a client abroad deducts from your payment and pays to its own tax authority before you receive the balance. For example, US rules tax foreign persons at a 30% rate on some US-source income, generally collected by withholding, as the IRS Form W-8BEN instructions explain. India then gives relief so the same income is not fully taxed twice.

  • Who deducts: The foreign client or payer acts as the withholding agent. Under US rules, the payer may rely on a valid Form W-8BEN to apply a reduced rate or exemption at source, according to the W-8BEN instructions.
  • Indian relief: India allows relief either through a tax treaty under section 159 of the Income-tax Act, 2025 or, where no treaty exists, through a deduction under section 160 of the same Act.
  • Treaty rate: A treaty can limit or remove the foreign tax. For example, Article 15 of the India-US tax treaty makes independent professional services taxable only in the country of residence, unless there is a fixed base or a stay of 90 days or more in the other country.
  • Old Act: The Income-tax Act, 1961 was repealed from 1 April 2026, but it still governs tax years that began before that date, as the Income Tax Department FAQ explains.

For the general term, see what is withholding tax. For treaty basics, see what is DTAA. For the filing steps, see foreign tax credit and Form 67, and for US company forms, see W-8BEN-E for Indian companies.

Who can claim Indian relief for foreign withholding tax?

A person resident in India can claim relief for income tax paid abroad on income that is also taxed in India. Section 160 of the Income-tax Act, 2025 covers residents taxed in a country with no tax treaty, and section 159 gives effect to treaty relief. The table below summarises common cases.

How do you claim credit in India for tax withheld by a foreign client?

You claim the credit in your Indian income tax return for the year in which the foreign income is taxed, supported by a statement of foreign income and tax. For tax year 2025-26, that statement is Form 67, filed on or before the section 139(1) due date. The steps below apply to both Acts.

  1. Collect the client's withholding certificate or statement showing the gross amount, the tax deducted and the period.
  2. Check whether India has a tax treaty with the client's country and read its article on relief from double taxation.
  3. Report the full gross foreign income in your Indian return, including the part withheld abroad.
  4. Work out the credit: the foreign tax paid, limited to the Indian tax on that same income.
  5. For tax year 2025-26, file Form 67 on the e-filing portal on or before the return due date, then file the return claiming the credit.
  6. For tax year 2026-27 onward, use the form prescribed under the Income-tax Rules, 2026; the department says new ITR forms under the 2026 Rules will be notified before the due dates.
  7. Keep all foreign tax documents, invoices and bank credit records for later queries.

How does a tax treaty change foreign withholding tax for Indian freelancers?

A treaty can cut the foreign tax at source, or allocate taxing rights only to India. Under Article 15 of the India-US treaty, professional services income of an Indian resident is taxable only in India unless a fixed base or a 90-day stay exists. Article 25(2)(a) then sets India's credit, capped at the Indian tax on that income.

  • Read the services, business profits and relief articles of the treaty with the client's country.
  • Give the client any form it needs to apply the treaty rate before payment.

How can you stop a US client from withholding 30% on future invoices?

Give the US client a valid Form W-8BEN (individuals) or Form W-8BEN-E (entities) before payment. The W-8BEN instructions state that failing to provide the form when requested may lead to withholding at 30% or the backup withholding rate. The form goes to the payer, never to the IRS.

  • IRS rules source personal services income where the services are performed, so work done from India is generally not US-source income.
  • A Form W-8BEN generally stays valid until the end of the third calendar year after signing, unless circumstances change.

What happens to foreign withholding tax that exceeds the Indian tax on the same income?

The excess is not credited in India. Section 160(1) of the Income-tax Act, 2025 allows relief at the lower of the Indian rate and the foreign rate, and treaties such as India-US Article 25 cap credit at the Indian tax on that income. Any refund of the excess has to be sought from the foreign tax authority under its own rules.

What documents do you need to claim foreign tax credit in India?

You need proof of the foreign tax deducted, records of the gross income, and the Indian statement of foreign income and tax credit. For tax year 2025-26, that statement is Form 67. The table lists records worth keeping; check the exact proof requirements in the rules for your tax year.

What happens if you do not claim credit for foreign withholding tax in India?

If you do not claim the credit, you pay full Indian tax on income that was already taxed abroad, so the same income is taxed twice. Leaving the gross income out of your return creates a different problem: your Indian return understates income. Both outcomes can be avoided with the right records.

  • Double tax: Indian tax is computed on the gross foreign income, and without the credit, the tax withheld abroad becomes a pure extra cost.
  • Under-reporting: Reporting only the net amount received in India understates income, since the tax withheld abroad was part of your earnings.
  • Late statement: For tax year 2025-26, Form 67 is linked to the section 139(1) due date; missing it puts the credit claim at risk.
  • Excess tax: Foreign tax above the Indian tax on the same income cannot be credited in India and is lost unless the foreign country refunds it.
  • Wrong year: Tax year 2025-26 claims follow the 1961 Act and tax year 2026-27 claims follow the 2025 Act, as the Income Tax Department FAQ explains.

If the return is already filed without the credit, check whether a revised return is still possible for that year; the ITR FAQ confirms that revised returns for AY 2026-27 are governed by the 1961 Act. For future invoices, give the client the treaty form before payment.

How is foreign tax credit calculated for income taxed abroad?

Foreign tax credit equals the foreign tax paid, limited to the Indian tax on that income. Say a freelancer has total income of Rs 20,00,000, Indian tax of Rs 3,00,000 before relief, and Rs 10,00,000 from a client in a country with no treaty. The Indian rate is 15%. If the client withheld 10%, the credit is Rs 1,00,000. If it withheld 20%, the credit is Rs 1,50,000.

What are the common mistakes with foreign withholding tax and foreign tax credit?

  • Net income: Reporting only the amount that reached the bank and leaving out the tax withheld abroad.
  • No proof: Not asking the client for a withholding certificate or statement at the time of payment.
  • Late form: Filing Form 67 after the section 139(1) due date for tax year 2025-26.
  • Wrong Act: Citing 1961 Act forms for tax year 2026-27, or 2025 Act sections for tax year 2025-26.
  • No treaty form: Not giving a US client Form W-8BEN or W-8BEN-E before payment, which may lead to 30% withholding.
  • Full credit: Claiming the whole foreign tax when it is higher than the Indian tax on that income.

Frequently asked questions

Is Form 67 still used after the Income-tax Act, 2025 came into force?

Form 67 is used for claims under the 1961 Act, which still governs tax year 2025-26 (AY 2026-27). The Income Tax Department lists Form 67 as due on or before the section 139(1) date. For tax year 2026-27 onward, forms are prescribed under the Income-tax Rules, 2026, so check the replacement form number.

Does foreign withholding tax reduce the income you report in India?

No. You report the gross foreign income in India, including the amount withheld abroad, and then claim credit for the foreign tax against Indian tax on that income. Reporting only the net amount received understates income and also leaves no basis for claiming the foreign tax credit. Keep the client's withholding statement as proof.

Can an Indian freelancer get a refund from India of foreign withholding tax?

India gives credit only up to the Indian tax on the doubly taxed income. Under section 160 of the Income-tax Act, 2025, relief is at the lower of the Indian rate and the foreign rate. Any foreign tax above that amount is not refunded by India and must be claimed from the foreign tax authority, if its law allows.

What is the Indian rate of tax under section 160 of the Income-tax Act, 2025?

Under section 160(3)(c), the Indian rate of tax is Indian income-tax, after relief under the Act but before double taxation relief, divided by total income. For example, Indian tax of Rs 3,00,000 on total income of Rs 20,00,000 gives an Indian rate of 15%. Credit is then compared with the foreign rate.

Does a Form W-8BEN stop US withholding on payments to an Indian freelancer?

A valid Form W-8BEN lets a US payer treat you as a foreign person and apply any treaty reduction or exemption. The IRS instructions say the form goes to the payer, not the IRS, and that failing to provide it when requested may lead to 30% or backup withholding. Companies use Form W-8BEN-E.

Is foreign tax credit available if India has no DTAA with the client's country?

Yes. Section 160 of the Income-tax Act, 2025 gives a resident a deduction from Indian tax where income is taxed in a country with no agreement under section 159. The deduction is computed on the doubly taxed income at the Indian rate or the foreign rate, whichever is lower. Equal rates use the Indian rate.

Which Act applies to foreign withholding tax deducted in April 2026?

Income earned from 1 April 2026 falls in tax year 2026-27, which is governed by the Income-tax Act, 2025. The Income Tax Department FAQ explains that the 1961 Act still applies to tax years that began before 1 April 2026. So a claim for April 2026 income follows sections 159 and 160 of the 2025 Act.
