What does FEMA mean in simple words?
FEMA is the Act that governs foreign exchange dealings in India. RBI issues the detailed rules as regulations under it. The current export rules are the Foreign Exchange Management (Export and Import of Goods and Services) Regulations, 2026, notified as FEMA 23(R)/2026-RB. RBI states they are made under sections 7 and 8, sub-section (6) of section 10 and sub-section (2) of section 47 of the 1999 Act, and come into force from 1 October 2026. Exporters mainly meet FEMA through their AD bank.
For example, a design agency invoices a client abroad. Under the FEMA export regulations, the agency makes the required declaration and brings the payment in through its AD bank.
Why does FEMA matter for Indian exporters and freelancers?
- Declaration: The 2026 regulations set the export declaration process. Check the regulation text and your AD bank for the form that applies.
- Realisation: The regulations set a time to bring export proceeds into India. See the FEMA rules for exports.
- Bank compliance: Your AD bank applies FEMA rules when it processes your receipts and reports purpose codes.
- GST and tax: FEMA is separate from GST and income tax. Meeting one does not satisfy another.
How does FEMA work?
The Act sets the framework and RBI sets the detailed rules through regulations. Exporters follow the regulations through their AD bank.
- Parliament enacts FEMA, 1999.
- RBI notifies regulations under the Act, such as the 2026 export regulations.
- RBI issues circulars to AD banks on procedure.
- The AD bank applies these rules to exporter transactions.
- The exporter keeps records and follows declaration and realisation requirements.
Who does FEMA apply to?
FEMA export rules apply to people in India who export goods or services and receive foreign exchange. Whether a particular step applies depends on the regulation text and your transaction.
- Identify whether you export goods, services or both.
- Read the 2026 export regulations.
- Confirm with your AD bank which declaration applies, see EDF.
- Track realisation of proceeds in your records.
- Check RBI circulars for later changes.
What do people get wrong about FEMA?
- Only for companies: FEMA applies to individuals too, such as freelancers, where the regulations cover their transactions.
- Same as FERA: FEMA is the current foreign exchange law. Rely on the current FEMA text and RBI regulations.
- Same as RBI: RBI administers FEMA but the Act is the law.
- Same as tax: FEMA is not a tax law.
