Short answer

Form W-8BEN is the Certificate of Foreign Status of Beneficial Owner for United States Tax Withholding and Reporting for individuals. A foreign person gives it to the withholding agent or payer, such as a US client. It establishes foreign status and can support a claim for treaty benefits. It is not sent to the IRS.

What does W-8BEN mean in simple words?

Form W-8BEN is a US tax form. According to the IRS, you give it to the withholding agent or payer if you are a foreign person and the beneficial owner of an amount subject to withholding. The instructions say not to send it to the IRS and to give it to the person who requests it. An Indian freelancer uses it to tell a US client that the freelancer is a foreign person. Companies use a different form, W-8BEN-E.

For example, a freelance developer in Pune is onboarding with a US client. The client's accounts team asks for a W-8BEN. The developer completes it with name, country of residence, tax identification number and signature, and sends it to the client, not to the IRS.

Why does W-8BEN matter for Indian exporters and freelancers?

  • US withholding: The payer uses the form to decide how to treat the payment for US withholding. Leaving it out may lead the payer to apply its default rules. Ask the payer what applies.
  • Treaty claim: The instructions explain that Line 9 identifies your country of tax residence when you claim reduced withholding under a tax treaty.
  • Income tax in India: The form does not change your Indian tax. Ask your adviser how foreign income and any tax deducted abroad are reported, see DTAA.
  • Bank and GST: The form is a US tax document. It does not replace the invoice, bank advice or FEMA records.

How does W-8BEN work?

The payer asks for the form, the foreign individual completes and signs it, and the payer keeps it on file for withholding and reporting.

  1. The US client or payer requests a W-8BEN.
  2. You enter your name, country of citizenship, residence address and tax identification numbers.
  3. You complete the treaty lines if you claim treaty benefits.
  4. You sign and date the certification.
  5. You give the form to the requester and keep a copy.
  6. You send a new form if your circumstances change or the old one lapses.

How do you get and fill in Form W-8BEN?

You download the current form from the IRS website, complete it, sign it and give it to your US payer. Do not send it to the IRS.

  1. Download the current Form W-8BEN from the IRS page.
  2. Fill in Part I with your identity, country of citizenship and addresses.
  3. Give your foreign tax identification number, if asked, as set out in the IRS instructions for Line 6a.
  4. Complete the treaty claim in Part II only if you claim treaty benefits, see the step-by-step guide.
  5. Sign and date Part III.
  6. Hand the form to the payer and keep a copy.

What is the difference between W-8BEN and W-8BEN-E?

W-8BEN is for individuals, while W-8BEN-E is for entities such as companies. Choose the form that matches the legal status of the person being paid.

What do people get wrong about W-8BEN?

  • Filing with the IRS: The IRS instructions say not to send Form W-8BEN to the IRS. Give it to the requester.
  • Lifetime: Under the IRS instructions the form generally stays in effect from the signing date to the last day of the third succeeding calendar year.
  • For companies: A company uses W-8BEN-E, not W-8BEN.
  • Tax advice: The form states your status. It does not decide what tax you owe in India.
